would look at 70#'s??
He is down another 9 pounds and now is 149 and not going
to go any further.. as it will be unhealthy for him and
animal abuse charges for the owner.....
December 2013 Update
It is with Sadness that
Hammey, the Commerce City potbelly pig that made headlines, for being
the over weight pig after being in the same home for over 14 years, was
being evicted and his eviction date was December 11, 2013.
On December 7th, 2013 he was diagnosed with renal failure and laid to
rest in his only known home, and will remain there forever, as he will
be cremated and returned to his home with Roy & Janice Hayes.
We would like to thank everyone who has contributed to the Hammey Fund
for legal representation thru the Animal Law Center, also would like to
thank the Animal Law Center for representing Hammey, as without their
representation we would have never known how underhanded the Commerce
City Animal Control with their cases and the City Council for just plan,
"Not caring about the Potbelly Pigs in their City Limits." or even
considering to update their way our of date City Ordinance concerning
the potbelly pig.
Please remember Hammey for the difference that he tried to make in
Ordinances of Commerce City for other Potbelly Pigs, and moSt of all
Remember him for the gentle soul that he was and a family pet.
I am sitting here thinking as I type, In the end, Hammey gave it his
all, and now there isn't anyone that can ever take him away from his
forever home, as he is there for eternity.
I can also see him with his little wiggle butt, crossing Rainbow Bridge
smiling and looking back at the people in Commerce City Law Enforcement,
and saying to those who are welcoming him in heaven,
"My family gave it a good run" I'll be there forever, and those guys
will be gone in a couple of years........maybe then I can make a
difference for another potbelly pig.
Rest in Peace & know you will never be forgotten

June 14, 2013 Hammy Update
People have been
asking why Hammey is still having to be gone.
AT THIS TIME THIS IS THE ONLY EXPLANATION THAT I HAVE
Commerce City, Colorado has a very OUTDATED WEIGHT ORDINANCE (1994) OF
70 # LIMIT ON ALL POTBELLY PIGS. After the potbelly pig BREEDERS begin
to try different breeding technology the potbelly pig is no longer the
smaller version of the miniature domestic pig. Their weight varies from
small (100 #'s to large boned potbelly pigs up to 300#'s) and now
Commerce City is enforcing the 70# weight limits, which they saw Hammey
7 years ago and he was over the 70# limit at that time, but now there
was a neighbor dispute and Hammey is the VICTIM. So we encourage all
people in the Commerce City city limits to contact us so that you can be
named in the up coming advisement while we have a lawyer retained SO
PLEASE STEP FORWARD AND JOIN IN WITH HAMMEY & THE PIG-A-SUS TO MAKE IT

June 12, 2013 Hammy Update
Hammey's happenings today June 12, 2013 in
the Hammey vs. Commerce City Colorado court case.
With the help of the attorney, & the DA there was a plea bargain
Now you will have to follow this real close:
Hammey was given a 6 month deferred sentence and on
December 12, 2013 he will no longer be allowed in the City Limits of
Commerce City ,Colorado. During this 6 month period NO FURTHER CHARGES
CAN BE BROUGHT AGAINST HAMMEY OR HIS OWNER.
Janice the owner was give 12 month deferred sentence on the case, along
with 12 hours of community service done at a listed Non-Profit, plus 25
$$ court fees, which have been paid, She for the 1st 6 months can have
no new charges brought against her and the last 6 months, if there has
been no changes made in the CURRENT ORDINANCE, and she brings Hammey
back home in Commerce City, she will receive some jail time...
EVERY ONE AGREED UNER THE CIRCUMSTANCES THAT THIS WAS THE BEST WAY TO
GO.. SO THE CASE IS CLOSED IN THE CITY OF COMMERCE CITY, COLORADO.

have several plans to "run with". I CAN NOT ELIBRATE, AS THERE IS

SAY AT "ALLSTATE INSURANCE" WE ARE IN GOOD HANDS...
I personally do not see this as
the end. That would be to easy and there are a lot of people in the
justice system that DON'T WANT TO ADMIT THAT THEY ARE WRONG ON THIS
CASE. SO HAMMEY IS THE VICTIM HERE...

We, (myself & the Hayes family) spoke with the City
Council on Monday, April the 15th, as their city council meetings are
held on Monday nights, to see if we had been placed on the agenda to
speak about the existing Potbelly Pig Ordinance regarding it being
outdated and to shed current information and education on the Potbelly
Pig and weight issue's. We (I made booklets 15 to be exact, and Mr.
Hayes presented them to the council on March 4th for review.) Evidently
that was not the case because: on our way to Commerce City for Hammey's
hearing , Mr Hayes called very distraught, that he has just received an
email copy of an InterOffice Memo to the City Manager from Patrol
Division Commander Larry Woog, containing the information previously
read in the post. Evidently they as government personal have more
experience in the potbelly pig weight due to bone structure, age and
enviroment, because they failed to contact any of the references that
were provided such as veterinarians, rescue people, Veterinarian
Universities etc. We gave excellent reference to education, but they
choose to use other city ordinances.
So we were given no other CHOICE, but to attempt to obtain council to
represent the Hayes family and Hammey.
The Animal Law Center located in Wheatridge, Colorado after several
calls to the on the way to Commerce City did agree to be retained prior
before going before the Judge.
When we arrived at the Court, we were ask to stand outside in the lobby,
there were 11/12 people, plus Fox New 31 from Denver, The security
officer then came back out and ask to speak ONLY to the Hayes family,
WELL, that didn't fly,,,, at all. The Hayes and myself went in to speak
with the DA.
As soon as we had gotten into his office he said, to start
DA: You are here to ask for a continence,
Hayes said , Yes we are,
DA: OK, may I ask why,
Hayes: Because of the Interoffice Memo that we received less than 24
hours before the trial, that says they are willing to DO NOTHING
DA: Have you already retained an attorney and who?
Hayes: I believe that Sioux is taking care of that.
Sioux: Animal Law Center out of Wheatridge
DA: Have you retained and met with them
Sioux: We are verbally retained and we meet with them when we leave
here, depending on what the Judge says.
DA: Have a seat in the hearing room and I will be out
Judge calls the case:
Judge: Mrs. Hayes, why have you just decided to retain an attorney, we
have given you one continuance already and I am not inclined to give
another, and the DA does not recommend that we do either.
Hayes: Do to the interoffice memo that we received yesterday, we feel
that we need an attorney to represent us to get a fair trial,
Judge: and you have contacted Animal Law Center?
DA: ( motioning to the Bailiff) "get my guys in here" Referring to A/C
DA: Judge, in light of some new discovery that has just be brought to my
attention, I feel now that maybe we should grant a continuance?
Judge: And what would that be?
DA: It seems that there is a TAPE RECORDED CONVERSATION BETWEEN ONE OF
THE OFFICERS AND MS. HAYES?
DA. So, I believe that we should grant Ms. Hayes a continuance?
Judge: After a minute or 2: Mrs. Hayes, Even if I were not going to
grant you another continuance, Under the Law, I will have to do so at
this time, do to there being new discovery what the DA was not aware
Do you by chance have the number for the Animal Law Center? I would like
to talk to them and jointly set a date for trial?
Hayes: No sir, I do not, but I believe that Sioux does.
Judge: I just have the office out front call him and correspond a trial
date Could you just sit in the lobby for a few minutes while we get this
Hayes: Yes sir, and thank you for the continuance>
When we got outside of the courtroom, I was furious.... They have known
all along that they had this. They did not ask permission to tape any of
the conversations that
Mrs Hays can remember. They did ask her permission to take a picture of
In which the a/c officer referred to him as the "Hog" and in several
written correspondence also as the hog...
So with this new development we did retain the attorney.
The Hayes family does not have enough money to pay for the attorney.

April 23, 2013 Hammy Update:
Well hello everyone,
We are traveling to get to Commerce City when I got a phone call from
the Hayes family,
The attached email was sent to them from the Commerce City city manager
Brian McBroom from the PATROL DIVISION COMMANDER LARRY WOOG.
I spoke with the City Council Monday Morning and Mr. Hayes spoke with
them Monday afternoon and they assured us that they did not have us on
the agenda as of yet. Monday night, the 23 rd of April, was the study
group for the city council this INTEROFFICE MEMORANDUM was sent out on
the 19th of April. So we received this email less than 24 hours before
the "Hearing before the Judge" on the 24th at 10:30 A.M.
This is a horrible shock and kick back for Hammey trail by Judge
I have contacted The Animal Law Center in Westminster, Colorado, which
consist of several different types of attorney's and they are willing to
work with us. They feel that the Judge tomorrow will rule in the cities
favor and Hammey will have to be removed as he was there 2 years after
their Ordinance was put in place. Tomorrow we will appeal whatever comes
forth and meet with the lawyers.

The Hayes family are just a common ordinary family
and work everyday to maintain their family. They do not have money for
this type of expense, but what they do have is UNIQUE LOVE for this
Potbelly Pig Hammey and they are willing to do what ever is necessary
for him to be able to live his life out where he has lived his whole

they are wrong and putting another animal in their city limits in
jeopardy. If they won't use updated Ordinances and update Veterinarian
information, why do they have animals at all allowed in their city?

One thing that is very important: We submitted a request in person on
March 4th at the City Council meeting to be put on the agenda to address
their "Out of Date Ordinance regarding Potbelly Pig and particularly the
weight issue." We have heard nothing from the City Council and have been
calling every week asking if we are on the Agenda. with no results.
This does not seem quite far to the Potbelly Pig nor the people who own
potbelly pigs. This is a whole new subject for discussion. Hopefully the
Judge can shed some input on the City Council and in his decision let
enjoy the rest of his life with the only family that he has ever known.

Hammey the 14 year old potbelly pig living in Commerce City, has been
issued a warning violation due to over weight. He has been living at the
same residence for the last 14 years. Due to genetics, not the care of
the animal, he has exceeded the weight limit imposed in 1994 of 70
pounds when the ordnance was passed to allow potbelly pigs as household
Right now I am so upset with the way things are going. I received an
email today from the Assistant City Attorney Gregg Graham, from Commerce
City, stating that I would have to contact the City Manager
McBroom, as he is in charge of things like this.
Thank you for the information regarding
the pot-bellied pig owned by Roy and Janice Hayes and known as “Hammy.”
As you are aware, the law in Commerce City is that pot-bellied pigs
cannot exceed 70 lbs. Please understand that whether or not one may
consider the 70lb limit to be unreasonable does not impact the City’s
enforcement of the law, and neither the City Attorney’s Office nor the
City’s Animal Control Agents are authorized to ignore the law.
Additionally, because the Hayes’ are not themselves a bona fide research
institution, their affiliation with your group does not exempt them from
the City’s pot-bellied pig requirements.
The City’s specific pot-bellied pig
requirements have been on the books since 1994. Prior to that time,
pot-bellied pigs were considered livestock and were prohibited in
residential neighborhoods. Thus, the current law regarding pot-bellied
pigs was in effect even when the Hayes’ obtain their first pot-bellied
pig in 1995. The fact that Animal Control may not have been aware of a
violation, regardless of how long that violation existed, does not
exempt the Hayes’ from enforcement of the law. Pot-bellied pigs
exceeding 70 lbs are just as illegal now as they were then.
I would recommend that you contact City
Manager Brian McBroom if you wish to change the weight limitation in the
City’s ordinance. Please be aware that an ordinance change typically
takes 8 – 10 weeks, although occasionally a change can get pushed
through in a little less time. It is my understanding, however, that the
Hayes’ have only another 8 – 10 days to comply with the order from
Animal Control Agent Madrid. Mr. McBroom can be reached at 303-227-8814.

I forward the email to the Hayes family and informed them that we were
waiting for a return call from the City Manager Office,
to see if we could resolve this matter, which by the way never came
I just got home from attending a BLM meeting and was greeted by this
message from the Hayes Family.
"We cannot bear to see their beloved Hammey possibly taken from his only
home for the last 14 years, due to a new neighbor conflict,
drawing attention to their house pet and being placed in a facility that
is not acceptable for anything but dogs and cats."
Hammey the potbelly pig,was issued a warning to be removed from the home
within 10 days, due to the fact that his weight was out of compliance.
His current weight is 130 pounds, with bone density to that of a St.
Bernard dog. His normal weight should be another 15 to 20 pounds for his
bone structure. The City of Commerce City, Assistant City Attorney today
in his response was pretty negative that they were not interested in
updating their so very outdated and incorrect ordnance, that the Hayes
family has chosen to have their beloved pet of 14 years euthanized and
not risk the fact that they have to have him taken from their home for
something that is not the potbelly pigs, nor their fault.
It is the fault of the people who compose the ordnances, who do not do
their homework and information on what they are making laws from. This
ordnance was approved in 1994, 18 YEARS AGO,
when there was still a chance that an original potbelly pig may have a
slight chance of survival, under nourished or on a starvation diet to
keep them small and even at that time the normal weight was a 100# PLUS,
depending on genetics, There are many breeds of dogs that over the 70
Pound limit, but do you see them being sited for non compliance on
weight issues? WEIGHT FACTOR IN A POTBELLY PIG IS LIKE IN A HUMAN,
GENETIC Remember for those of you who are not familiar with the genetic
of a swine, rather potbelly pig or domestic pig, they are the closest to
the human being. This is why different breeds of swine, (Potbelly pig
included, Gottenberg pigs, Yucatan are used in Medical research, they
are comparison to the human).
From talking to Officer Madrid, a Animal Control Officer from Commerce
City and the email from the attorney's office I do not see much hope
that we can save Hammey's and let him continue to live his life in a
home of love and protection., We at the Pig-A-Sus Homestead Sanctuary,
do commend the Hayes family for not wanting to subject their beloved pet
to the justice system, that will do nothing to improve the betterment of
life for the potbelly pigs in their city.
I am sure that the many other Potbelly Pigs located in this city will
come forth and there will be more rebuttal.
The Hayes family has ask that I contact a local vet to come to their
home, so that Hammey does not have the stress of being displaced and
traumatized in his final hours.
It is very troublesome for me, that being Western Colorado Potbelly Pig
Educational Health Center located on the Western Slope and Pig-A-Sus
Homestead Sanctuary for the Potbelly Pig, that the Cities who have given
approval for the Potbelly Pig as a household pet, will not contact us
for information or ask for referral to CSU Veterinary School of Medicine
or Local Potbelly Pig Veterinarians who care for these animals and have
the expertise to help make correct laws and not have to be the one to
come and correct someone else mistake from not having correct
information in the first place, but doing the most unthinkable deed of
euthanizing a perfectly loved and cared for pet.
I will commend the town of Parker, Colorado, as in 2010, we worked hand
in hand with their city council and city attorney to present an ordnance
that all could live with and the weight limit was set at 150 pounds
which is very close to the weight of an adult potbelly pig. It was an
honor to work with a City Council, in which the members did their own
research after the first meeting and presented us with their questions
and concerns. PLUS, any potbelly pig that was at that time located in
their city limits was given 30 days to come forth, be registered, pay
the fee and be put under a "Grand fathered Clause", which by the way,
DOES NOT EXCLUDE them from being ticketed on issues, but does
acknowledge the weight factor and vaccination records.

diets since 2007, under the direction of veterinarians and Western
Colorado Potbelly Pig Education Health Center. There is not an ounce of
fat on him. His bone structure is extremely large and has been his
entire life. We would like to thank all of those who have come forth,
prepared to fight this battle for Hammey, but we would like him to
"Cross over to Rainbow Bridge" with the dignity that he so deserves, not
the reminder of someone else ignorance that has cost him his life."
